Therefore, each article has a unique DOI number.</p> <p style="text-align: justify;">&nbsp;</p> Postgraduate Studies of UIN Sunan Ampel Surabaya, Indonesia en-US Islamica: Jurnal Studi Keislaman 1978-3183 Religious and Cultural Embodiment in the Land of Osing: A Portrait of Hadrami Community in Banyuwangi, East Java https://islamica.uinsa.ac.id/index.php/islamica/article/view/1090 <p>This paper investigates the portrait of Hadrami community in the land of Osing in Banyuwangi, East Java. Banyuwangi is one of the legendary towns where the Majapahit kingdom’s heritage was well preserved. This town is associated with indigenous ethnic people known as Osing, who have their own traditions, language, customs, and culture. Madurese, Javanese, Sundanese, Chinese, Europeans, and Hadramis are among the other ethnic groups that inhabit this region. Its diversity of languages, ethnic groups, and religions made Banyuwangi a welcoming place for Hadramis for centuries. During the Dutch East Indies, Hadramis conducted extensive trade via the island’s South Sea; this area was a trading port in East Javat. Hadrami community have permanently lived in the land of Osing since the early 18th century, bringing their livelihood, inter-ethnic marriage, Islamic teachings, and Arab culture. Therefore, this research examines religious and cultural embodiments between native people and Hadrami community in the land of Osing. The findings of this research show that Hadrami community in the land of Osing adopted local language for Islamic <em>da‘wah</em>. This humanitarian crisis is a result of the Israeli-Palestinian conflict since the 1948 Nakba incident, which continues to this day. This article reveals and analyzes the humanitarian crisis faced by Palestinian women in this novel using the state-ibuism approach and qualitative descriptive methods. State-ibuism is defined as the ideology of women’s actions in taking care of their family, group, or state to support male power. Kanafani’s main idea for Palestinian women to rebuild the Palestinian national narrative is a pro-natal movement using their wombs. Their wombs are positioned as a battlefield for the Israel and Palestine movements to determine the definition of their nation. Along with this argument, religious ethics can be utilized in improving the quality of public life by revitalizing religious doctrines to support the betterment of public life quality. In doing so, reactivating the mechanisms of inductive rational thinking such as ijtihad or <em>tajdīd</em> is badly needed in order to deconstruct old-fashioned understanding of religious teachings prevalent in society regarding all issues contradictory to the betterment of public life quality such as Human Development Index (HDI), life expectancy index, health issues, and so forth. Various polemics that occurred due to the continuous influx of refugees, giving rise to a negative stigma in society. This research uses a descriptive analysis method based on data sources in the literature review. The result shows that the Indonesian government's policy towards Rohingya refugees is appropriate based on the <em>maṣlaḥah mursalah</em> perspective. Therefore, efforts that Indonesia can make are to fulfill the rights of the Rohingya people only when they become refugees or asylum seekers in Indonesia. Rights that can be fulfilled as <em>maṣlaḥah </em>include: 1) freedom of religion, the right to live and be free from fear (maintenance person) in this case Indonesia has built an Integrated Community Shelter as a place to live for Rohingya refugees and built a mosque or place of worship for Rohingya ethnic Muslims named the Arakan’s mosque; 2) Fulfilling the guarantee of safety, guaranteeing human honor; 3) The right to maintain one's tribe or ethnicity, the right to marriage to raise offspring; 4) The right to education (maintenance of mind); 5) The right to obtain a decent living by being given the opportunity to earn a living (property maintenance).</p> Almirah Meida Risfina Amirul Haqi Hafidhuddin Rosyad Copyright (c) 2024 Almirah Meida Risfina, Amirul Haqi, Hafidhuddin Rosyad http://creativecommons.org/licenses/by-nc-sa/4.0 2024-05-10 2024-05-10 18 2 75 94 10.15642/islamica.2024.18.2.75-94 Artificial Intelligence Efforts in Addressing the Humanitarian Crisis: A Study on Rohingya Refugees https://islamica.uinsa.ac.id/index.php/islamica/article/view/1121 <p>Efforts to address the humanitarian crises among Rohingya refugees, including violence against women, human trafficking, and other inequalities, have been insufficient. This paper explores how artificial intelligence (AI) can help mitigate these issues through a qualitative approach. Data was gathered via questionnaires and supported by various relevant sources, followed by thorough analysis. The findings indicate that AI can play a significant role in addressing humanitarian crises by improving mental health services, detecting potential security threats, aiding in language translation, and enhancing cybersecurity. However, the use of AI also presents challenges, such as biased or inaccurate data, threats to data security, reduced human skills, privacy concerns, and job displacement. The Qur’an encourages the use of the universe’s resources wisely, suggesting that technology, when used judiciously, aligns with Islamic teachings. Each region has their own identity in strengthening the uniqueness of its traditions. Inclusive versus exclusive has a different sense, but both of them have the same sense of preserving, caring, and sustaining local traditions. There are two important things that must be explored in this study; 1), how the wedding traditions in Kediri, East Java, and Lombok, West Nusa Tenggara, are comparable? 2), how the uniqueness of each region’s wedding traditi-ons is in realizing inclusive and exclusive local traditions? Based on the wedding traditions comparison, it was found that 1), each region possesses a variety of historical values. 2), the Siman and Wetu Telu community have their own dynamic in responding and sustaining wedding traditions. Blummer’s symbolic theory helps to analyze and deepen the harmonization of the dialectics of local marriage traditions. Community dignity is maintained by preserving the values of local wisdom as a symbol of regional pride in East Java and West Nusa Tenggara. Many countries are trying to make new rules regarding asset confiscation, such as Indonesia and the Netherlands. This initiative cannot be separated from the United Nations Against Corruption (UNCAC) international convention, which requires all state parties to make their positive law. Islamic law also recognizes the confiscation of assets, especially in the Shāfi‘ī school of thought, which is known to be strict in its determination. Therefore, the main question in this research is how Islamic law, especially the Shāfi‘ī school of thought, views this phenomenon as a law in Islam. This research is normative legal research that focuses on analyzing and interpreting Islamic legal norms to explain the phenome-non of asset confiscation. The results of this study indicate that asset confiscation has begun to be used as the primary punishment in criminal and civil forfeiture models. The Shāfi‘ī school stipulates asset confiscation as <em>‘uqūbah mālīyah</em>, which can be applied both in violation of God’s rights and human’s rights.</p> Abd. Basith Junaidy M.
